Would you like to apply for Dutch Nationality and become a Dutch Citizen through naturalisation?
Would you like to become a Dutch citizen? If so, you may submit an application for naturalisation to the Dutch Immigration and Naturalisation Service (IND). This authority assesses whether you meet all applicable requirements and ultimately decides whether Dutch nationality will be granted. In this article, we explain what naturalisation entails, who may be eligible, and how the procedure works.
What is naturalisation?
Naturalisation is the legal procedure through which a non-Dutch national can acquire Dutch citizenship. Once naturalised, you obtain the same rights and obligations as a person who was born with Dutch nationality. These include, among other things, the right to vote in national elections, the ability to apply for a Dutch passport, and the freedom to travel within the European Union.
Who is naturalisation intended for?
Naturalisation may be of interest to individuals who have been living in the Netherlands for an extended period and have established their lives here. For example, you may qualify if you have lawfully resided in the Netherlands for several years, are sufficiently integrated into Dutch society, possess an adequate command of the Dutch language, and are willing to demonstrate your commitment to the Netherlands by making the Declaration of Solidarity. Whether you are eligible for naturalisation depends on various requirements. Each application is assessed on an individual basis.
How is your application assessed?
When evaluating a naturalisation application, the authorities consider factors such as your residence status, your level of integration into Dutch society, and any criminal record. In certain cases, additional investigations may be conducted. The authorities may also seek advice from the municipality in which you reside. Based on all available information, a decision will then be made regarding your application.
How Long Does a Naturalisation Procedure Take?
In principle, a decision on your application must be made within 12 months. This period begins once the application fee has been paid. If the application is incomplete or particularly complex, processing may take longer. If this occurs, you will be notified in writing.
Approval of Your Application: The Naturalisation Ceremony
If your application is approved, you will receive a letter informing you that you are eligible to become a Dutch citizen. The letter will also indicate to whom the naturalisation applies, such as any minor children included in the application. However, you do not become a Dutch citizen immediately upon approval. Dutch citizenship is only formally acquired once the official naturalisation decision has been presented to you during the naturalisation ceremony. You will receive an invitation to attend this ceremony from your municipality. During the ceremony, you will receive the naturalisation decision, which is signed on behalf of the King. You will also make the Declaration of Solidarity. The ceremony generally takes place within a few weeks after you receive the invitation.
If your application is intended to be rejected or is rejected
Before a final decision is made, you may first receive a notice of intended rejection. This document explains that the authorities intend to reject your application and sets out the reasons for doing so. You will be given an opportunity to respond. This response is referred to as a zienswijze (statement of views). At this stage, you may submit additional documents or provide further explanations in support of your application. After your response has been received and reviewed, a final decision will be issued. This decision may be either positive or negative.
If the authorities conclude that you do not satisfy the applicable requirements, your application will be rejected by means of a formal decision. You may lodge an objection against this decision, explaining why you disagree with the outcome. If the objection is also rejected, you may appeal to the court. The court will then assess whether the decision was made in accordance with the law and proper procedure.
